نفت قيادة الجيش ان تكون أوقفت القاصر طوني شعيا (14 عاما)، في معالجتها لاحد الحوادث الامنية، معربة عن شكوكها من اثارة الموضوع.
واوضحت قيادة الجيش في بيان ردت فيه على "القوات اللبنانية" وتقدمها بدعوى ضد عناصر في المخابرات بما يتصل بملف شعيا، مشيرة الى ان خلفية الموضوع تعود الى "الاشكال الذي حصل في تاريخ 2/12/2009، حين اقدم القاصر طوني شعيا (14 عاما) مع ثلاثة آخرين، على الاعتداء بالضرب على طلاب من لون طائفي معين كانوا يستقلون حافلة مدرسية".
واضاف البيان انه "تم استدعاء المشاركين في الاعتداء، بمن فيهم المدعو شعيا، الى أحد المراكز العسكرية، وبسبب صغر سن كل منهم، تم تركهم، بعد ان نبهوا الى عدم تكرار ما اقدموا عليه، واعتبر الحادث فرديا".

القوات ردت على الياس المر: القاصر شعيا ليس كالذي وضع العبوة بجبل محسن

ردّت الدائرة الإعلامية في "القوات اللبنانية" على ما أثاره نائب رئيس مجلس الوزراء وزير الدفاع الياس المرّ، في مقابلته التلفزيونيّة مساء أمس، لجهة مُقارنته القاصر طوني كميل شعيا الذي حقّق معه في مديريّة المُخابرات بالقاصر الذي وضَع العُبوَة في جبل محسن، معربة عن آسفها لهذا التشبيه، ومعتبرة أنه أتى في غير محلّه الواقعي والقانوني، وقالت في بيان، "إن القاصر في جبل مُحسن وضَع عبوةً وأقرّ بالأمر وتمّ توقيفه بإشارةٍ من النيابة العامة العسكريّة، بينما القاصر طوني شعيا لم يرتكب أيّ جريمة ولم يكن متهماً بارتكاب أي جريمة، كما وأنّه لم يتمّ إطلاع النيابة العامة العسكرية بأمر جلبِه والتحقيق معه وجَعلِه يوقّع على ورقة بيضاء".
وجددت "القوات اللبنانية" مطالبتها المر بـ"عدم ترك الاجهزة الأمنية تقوم بأيّ تجاوزات بعد اليوم خصوصاً بعد كل ما عناه الشعب اللبناني خلال زمن الدولة الامنية الماضية، مُكتفياً بهذا القدر من سَرد الأمور، لا سيما وأن القاصر طوني شعيا تقدم بواسطة وكيله بشكوى قانونية أمام المحكمة العسكرية بهذا الخصوص".
وفي السياق عينه، ردت الدائرة الإعلامية في بيان آخر، على ما بيان ورد بتاريخ اليوم في جريدة "النهار" صادر عن قيادة الجيش تناول الشكوى التي تقدمت بها "القوات اللبنانية" بموضوع شعيا/ آسفة لـ"مجموع المغالطات والمخالفات التي وردت فيه".
وأوضحت الدائرة الإعلامية أنه "ليس صحيحاً ما ذكره البيان من أن العملية كانت مجرد استدعاء شعيا الى احد المراكز العسكرية وتركه بعد تنبيهه بهذه البساطة، وقالت إن "شعيا اقتيد أولا بعد تكبيل يديه وتغطية رأسه بكيس أسود الى مخابرات بعبدا، ومن ثم نُقل الى مكان آخر عُومل فيه معاملة مهينة وسيئة و تعرض للضرب واللكم، عدا عن ارغامه على الركوع و تلقيه لضربة على رأسه من الخلف أسقطته أرضاً كون يداه كانتا مكبلتين خلف ظهره وعلى الرغم من تصريحه عن عمره تم تكذيبه بالرغم علماً انه كان يحمل بطاقة هويته". وسألت: "هل هذه المعاملة هي مجرد تنبيه من جراء تضارب بالأيدي بين صبية لم يكن طوني شعيا حتى متورط فيه؟".
وتوقفت الدائرة الإعلامية عند ما جاء في بيان مديرية التوجيه لجهة غمزه من قناة "القوات" عند تساؤله حول اذا هناك توجه لإستخدام قاصرين للعبث بالأمن من جراء اثارة "القوات" لهذا الموضوع، معتبرة أن "هذا الكلام الصادر عن مديرية التوجيه كلاماً سياسياً يتنافى مع الدور المنوط بالمديرية ويشكل خروجاً عن القوانين المرعية الإجراء وعن مناقبية الجيش واتهاماً بحق حزب سياسي ممثل في الحكومة اللبنانية وفي المجلس النيابي لطالما كرر دعمه لقيام الدولة العادلة والمؤسسات". وأحالت هذا الموضوع الى وزير الدفاع الياس المر ليتخذ الإجراء المناسب بحق من أصدر هذا البيان.

LF criticizes army statement on party’s teenage supporter



The Lebanese Forces issued a statement Friday voicing regret over the wrong information reported in the Lebanese army’s statement on Toni Kamil Chaaya—a 14-year old LF sympathizer who was reportedly arrested by Lebanese army intelligence for allegedly beating non-Maronite students in December.
According to the LF, the army’s statement claimed that Chaaya had only been summoned to a base to receive a warning.
However, the LF said “Chaaya was first taken to an intelligence office in Baabda after having his hands tied and his head covered with a black bag,” after which he was transferred to another location, where he was beaten.
The statement added that even if the General Prosecutor summons a minor to take his testimony, the minor’s father must be present.
“[In fact] even the judge cannot interrogate the minor in court, except with the presence of a delegate of the juvenile court,” the LF added.
The LF also said it rejects the veiled allegations in the army statement that they are using minors to instigate security strife. Such rhetoric is political and inconsistent with the role of the Lebanese army command, the statement added.
The party added that they asked Defense Minister Elias al-Murr to take the necessary measures against the statement’s author. The LF added that it would also take appropriate legal action against the individual who prepared the statement.

Look at them launching a lawsuit against the army intelligence ..... and when we ask them to at least open the Saydet al Najat case they tell us we need an honest judge to do that .... eh ahlen ... el muhim kuwait and saudi arabi and sheikh Saad are happy

How about the rights of the LF and our rifa' who were accused and convicted in Saydet AL Najat case? How about the rights of the families who lost loved ones in that bombing?
Either you trust the judicial system or you don't. When you take the Army intelligence to court it means you trust it 100%.

go and check the law and check by who the LF was convicted and then you know that they can't open any case even if they want to...

If I do not know what I am not talkig about, I wouldn't talk like the majority (99%) of the Lebanese.
The law permits to open teh case again, go check with your boss and ask him to stop lying to you.

Yes the case may be opened again but to whose advantage & interest?
I doubt if our present legal justice will come-up with any final and just conclusion.
Raising tensions again, loss of time and money and no party is now ready to go into
this hassle again

If this is the case, then you should not open any case.

But to answer your points:
1- The case of Syadet al Najat bombing should be re-opened in the interest of the families who lost loved ones. In the interest of the LF that was condemned in the case. In the interest of teh rifa' who still can't go back to Lebanon and their names are not cleared. Because the majority of the LF beleived the lie that with the amnesty law everything is cleared.
2- Do not doubt the court. Open teh case and let the rifa' clear their names and the name of the LF if Geagea doesn't want to do it. You have the minister of Justice who is an LF, he can keep an eye on the process and he can for sure pick one clean judge.
why do you have him as minister if you can't trust his judgment?
3- Opening the church case is not creating tension and there is no hassle to clear the LF and the rifa' name from this case.

Cedars, in principle you are right
It seems to me that no one has interest to open the case ,starting from the families who lost their loved ones,
passing by the Lf as a party and ending at DSG himself.

What I am suspecting though, that one the conditions of DSG release from prison is not to open this case after his release. This may be the reason.

The purpose of opening the case is to find out the real perpetrators and clear the name of the charged
in this crime. This is an indisputable right for any one who wants to seek justice, if any.

Who said anything about suing judges? I am talking about re-opening the case to clear the LF and our rifa' names. And that can be opened. The LF knows that it can re-open the case and the only excuse Geagea been given in public on several occasion was "we need clean judges".

When Geagea says we need clean judges ,he probably means two things

1- Either he is not willing to re-open the case for a reason known to him and he gave that excuse.
2- Or Geagea knows that most of the Judges are motivated or manipulated or untrusty.
Whereas ,Geagea cannot predict or pre-select the judge who will be entrusted with his case.
